§ 1. Personal Data Controller

  1. The controller of personal data of Users of the Digimarket.info service is the Service Provider (hereinafter the "Controller"). The Controller can be contacted at: kontakt@digimarket.info.
  2. The Controller ensures the security of personal data by applying appropriate technical and organizational measures in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

§ 2. Scope and Purpose of Collected Data

  1. Data collected during registration and use of the service: email address, username, profile data, IP address, system logs, and data included in listings.
  2. Data collected for payment processing purposes: billing details, tax ID number (for companies), residential/registered address.
  3. Purposes of processing:
    1. Providing electronic services and managing the user account (Art. 6(1)(b) GDPR).
    2. Handling and processing payments and verifying listings (Art. 6(1)(b) and (c) GDPR).
    3. Pursuing claims and defending against claims (Art. 6(1)(f) GDPR — legitimate interest).
    4. Fulfilling tax and accounting obligations (Art. 6(1)(c) GDPR).

§ 3. Payment Processing and Stripe Services

  1. Payments for optional paid services (e.g. the Premium Listing) and transactions on the service are processed by an external payment service provider — Stripe Payments Europe, Ltd.
  2. Payment card data and sensitive financial data are entered directly into Stripe's encrypted form and are not stored on Digimarket.info servers (PCI-DSS compliant).
  3. Stripe collects and processes personal and transactional data in accordance with its own Privacy Policy (available at stripe.com) for the purposes of processing transactions, fraud prevention, and identity verification.

§ 4. Data Recipients and Third Parties

  1. User data may be transferred to entities processing data on behalf of the Controller:
    1. Hosting and database service providers.
    2. Payment system providers (Stripe Payments Europe Ltd.).
    3. Analytics and email-marketing tool providers.
  2. Data is not sold to third parties for marketing purposes.

§ 5. User Rights (GDPR)

  1. Every User has the right to:
    1. Access their data and receive a copy of it.
    2. Rectify (correct) their data.
    3. Erase their data ("right to be forgotten").
    4. Restrict the processing of their data.
    5. Data portability.
    6. Object to processing.
    7. Lodge a complaint with the supervisory authority (President of the Polish Data Protection Authority — PUODO).
  2. To exercise their rights, the User may contact the Controller at kontakt@digimarket.info.

§ 6. Cookies and Analytics

  1. The service uses cookies necessary for the proper functioning of the site (session handling, login, preference retention).
  2. The service may use anonymous analytical cookies to study site traffic and optimize the interface.
  3. The User can manage cookies through their own web browser settings.

§ 7. Data Retention Period

  1. Personal data is stored for as long as the account exists on the service.
  2. Billing and transactional data is stored for the period required by tax law (5 years from the end of the calendar year).
  3. If the account is deleted, data is anonymized or deleted, except for data necessary to defend against claims.
