§ 1. Personal Data Controller
- The controller of personal data of Users of the Digimarket.info service is the Service Provider (hereinafter the "Controller"). The Controller can be contacted at: kontakt@digimarket.info.
- The Controller ensures the security of personal data by applying appropriate technical and organizational measures in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
§ 2. Scope and Purpose of Collected Data
- Data collected during registration and use of the service: email address, username, profile data, IP address, system logs, and data included in listings.
- Data collected for payment processing purposes: billing details, tax ID number (for companies), residential/registered address.
- Purposes of processing:
- Providing electronic services and managing the user account (Art. 6(1)(b) GDPR).
- Handling and processing payments and verifying listings (Art. 6(1)(b) and (c) GDPR).
- Pursuing claims and defending against claims (Art. 6(1)(f) GDPR — legitimate interest).
- Fulfilling tax and accounting obligations (Art. 6(1)(c) GDPR).
§ 3. Payment Processing and Stripe Services
- Payments for optional paid services (e.g. the Premium Listing) and transactions on the service are processed by an external payment service provider — Stripe Payments Europe, Ltd.
- Payment card data and sensitive financial data are entered directly into Stripe's encrypted form and are not stored on Digimarket.info servers (PCI-DSS compliant).
- Stripe collects and processes personal and transactional data in accordance with its own Privacy Policy (available at stripe.com) for the purposes of processing transactions, fraud prevention, and identity verification.
§ 4. Data Recipients and Third Parties
- User data may be transferred to entities processing data on behalf of the Controller:
- Hosting and database service providers.
- Payment system providers (Stripe Payments Europe Ltd.).
- Analytics and email-marketing tool providers.
- Data is not sold to third parties for marketing purposes.
§ 5. User Rights (GDPR)
- Every User has the right to:
- Access their data and receive a copy of it.
- Rectify (correct) their data.
- Erase their data ("right to be forgotten").
- Restrict the processing of their data.
- Data portability.
- Object to processing.
- Lodge a complaint with the supervisory authority (President of the Polish Data Protection Authority — PUODO).
- To exercise their rights, the User may contact the Controller at kontakt@digimarket.info.
§ 6. Cookies and Analytics
- The service uses cookies necessary for the proper functioning of the site (session handling, login, preference retention).
- The service may use anonymous analytical cookies to study site traffic and optimize the interface.
- The User can manage cookies through their own web browser settings.
§ 7. Data Retention Period
- Personal data is stored for as long as the account exists on the service.
- Billing and transactional data is stored for the period required by tax law (5 years from the end of the calendar year).
- If the account is deleted, data is anonymized or deleted, except for data necessary to defend against claims.
